Main guidelines for Italy

  • Non-Italian companies may organise a promotion only via their Italian branch
  • The promotion must be entirely organised and carried out within Italian territory
  • Multi-country promotions are not allowed
  • Taxes on prizes and fiscal duties are on the Promoter’s responsibility
  • Prizes can be only goods or services: no cash prizes allowed
  • Once the official rules submitted to the authorities, the Promoter cannot change the terms & conditions or the mechanics of the promotion
  • The promotion starts when the promoter starts to advertise the activity (online or offline)
  • Advertising of the promotion must be truthful, clear and must contain minimum requirements
  • Data collected in relation to entrants must be stored on an Italian server. If the server is based outside Italy, the Promoter has to copy in real time (data mirroring) any relevant data collected in relation to the Promotion to an Italian based server
  • All winners must be selected in the presence of a notary or a public official
  • Any prizes that have not been won or claimed by winners must be donated to an Italian registered charity
  • For non-compliance with the Presidential decree: fine up to EUR 500,000
  • Unfair commercial practices: fine up to EUR 5,000,000
