WHO ARE THE SUBJECTS AUTHORIZED TO CARRY OUT PRIZE PROMOTIONS?

Prize promotions (competition, free gift promotions, etc.) can be organised only by manufacturing companies and businesses supplying or distributing goods and services, which make the object of the promotion, with the aim of advertising the company and increasing sales of the goods and services offered, as well as the visibility of the brand. Promotions can also be launched by those organisations representing business associations between companies, such as consortiums and cooperatives.

IS IT NECESSARY TO REQUEST MINISTERIAL AUTHORIZATION IN ORDER TO ORGANISE A PRIZE COMPETITION?

Such authorization is no longer required. However, as of Art. 10, item 1, of the Presidential Decree n. 430 of 26/10/2001, the subjects who intend to launch a prize competition must preventively communicate their initiative to the Ministry for Economic Development, by applying on-line through a dedicated form called “Prema CO/1, attaching the rules and regulations of the competitions, as well as a bank deposit receipt (bank /insurance guarantee or money deposit).

IS IT NECESSARY TO REQUEST MINISTERIAL AUTHORIZATION IN ORDER TO ORGANISE A FREE GIFT PROMOTION?

Such authorization is no longer required. However, as of Art. 10, item 1, of the Presidential Decree n. 430 of 26/10/2001, the subjects who intend to carry out a free gift promotion must preventively communicate with the Ministry for Economic Development, by applying on-line through a dedicated form called “Prema OP/1, attaching a bank deposit receipt (bank /insurance guarantee or money deposit). Moreover rules of the promotion must have been verified and registered by a public notary.

HOW LONG BEFORE THE BEGINNING OF THE PRIZE COMPETITION MUST THE COMMUNICATION REACH THE MINISTRY FOR ECONOMIC DEVELOPMENT?

The PREMA CO/1 form, together with the relevant required documents must be sent to the Ministry for Economic Development at least 15 days before the date marking the beginning of the competition.

WHAT IS THE PREMA CO/1 FORM?

The PREMA CO/1 form is the dedicated form set up by Ministry for Economic Development, to be filled out and sent on-line in order to properly communicate the launch of a new competition. The official communication of the launch of a prize competition is binding and must be forwarded at least 15 days before the beginning of the competition.

WHO TAKES CARE OF FORWARDING THE ADMINISTRATIVE PAPERWORK?

Companies promoting a competition can delegate such task to specialized agencies, for example IPM430, in order to fulfill any administrative requirements relating to the competitions or prize promotions.

WHAT ARE THE ADVANTAGES FOR COMMUNICATION OR ADVERTISING COMPANIES WHO DECIDE TO DELEGATE THE FULFILLMENT OF ADMINISTRATIVE REQUIREMENTS?

Through delegating all bureaucratic fulfilments to specialised consultants in the prize competitions field, companies are able to concentrate on the more creative and communicative aspects of their projects.

CAN A COMPANY HAVING ITS REGISTERED OFFICE ABROAD ORGANISE A PRIZE COMPETITION OR PROMOTION ADDRESSED TO ITALIAN CONSUMERS?

A company which is not resident in Italy may only organise a prize competition or promotion addressed to Italian consumers by acting through a representative who is resident in Italy, designated the “fiscal representative” (article 5 paragraph 2 of presidential decree 430/01).
This party who may either be an individual or a legal entity who is resident in Italy, represents the company abroad and, holding all necessary powers, in the name of and on behalf of the company, may carry out actions required, including all administrative and fiscal fulfillments.
This party must be appointed by means of a public deed in accordance with the provisions of article 1 paragraph 4 of presidential decree 441/97.
